Dear Experts I need this suggestion ASAP to prove I-140 ability to pay.
My Priority Date EB3 is Apr, 2004 and Company is in Loss for '04,'05 and '06 and so can't prove Net assets is greater than liablities or revenue is greater than proffered wage. However Company recently has been approved for line of credit which is greater than(>) the proferred wage.
The only way to show the ablity to pay is by showing the w2 that I have been paid the proffered wage since the priority date which is April 04. But I did not work from Jan'04 though mid of '05 because of health reason. During that time, I was paid by the disability insurance from the employer and I paid the tax for disability income while filing the W-2.
After I joined back on mid on '05 I have been paid more than proferred wage till present(June'07).
Does that satisfy the USCIS of the requirement of ability to pay or Not???
I need help ASAP.

My perm was filed in May 2007 in EB2. Got RFE in July 2007. Replied within 2 weeks. No response since then.

Can anyone tell me how serious this is?
We filled out all paperwork and forwarded to the lawyers 3 weeks ago, who filed it for us.
As I'm writing out a proxy for my dad to vote in my homecountry in upcoming elections, I somehow realize I wrongly entered his birthday on the G-325A, I put down June 6th, rather then June 8th. (got confused mixing it up with my husband's birthday)
Totally stupid :o, I know, I know. I'm so worried over this now, I can't sleep anymore, I can't eat anymore :(.
Of course I have already filled out a corrected G-325A & forwarded it to the lawyers handling our applications, but what could the consequences be? I'm so worried!
This was just a mistake made in a moment of not paying attention. :( :(

Not sure if this is the section to post this.
I am listing a few things that rake up my mind whenever I think of my prolonged (for me its prolonged though) stay in US. Dragging my feet over decisions to go back or not.
My posting is entirely my view. I would not be willing to trample on other's feelings. Just sharing a few things.
Cons
------
1) Leave everything behind as such in our native place and start everything afresh here. Looks cool for a start. But end up in a remote place with few people and no friends. Life starts to suck when you move on for some months in the remote place. Some like it most don't.
2) Trying to look back on what we missed being with family and friends, those good old days. Sitting on a wall/bench and chatting about daily happenings/cricket etc
3) Going back after some time to be bewildered on what happened to those buildings that were there. Before you digest all those, your vacation is gone. Poof
4) Most Importanty, live with fear on what will happen to those near and dear who have been wishing us good luck and health. Just imagining that fact that when you visit back next time, they might not be there, gives me sleepless nights. This is true even when you are back in your native place but at least you have a solace in seeing them whenever you require and help them in their times of need physically. Nothing is like what you do rather than telling others to do.
5) Missing all those religious events, happenings, special occasions.
Pros
-----
1) Live own life without any bindings (we can give umpteen excuses on how we are forced to live but its still our life)
2) Money factor
3) Move away from petty politics
4) Your own car.
5) Wifeys like it here as it moves them from home politics and they drive the home here.
These are my thoughts. Just sharing with a few who might care.

I know some people whose employers are lazy not to file new LCA when they switch jobs and move states. Some employers do it because they want to run payroll from certain states like Texas Florida where there is no state tax. I guess these people claim in consulate that they stay at the location where the employer is based and fly in -out to client places so do not need LCA of those places as they are not residents of that state. This is risky but consulates do not ask for LCA in most often cases never heard of any till now. Just pray you are lucky this time & from next time make sure your employer does it on time.

If you are a IV member living in NY and want to be actively engaged in the NY chapter activities, please send a PM to bottlemani. If all those in NY get together, it will be easier to plan joint visits to congress people: house members and senators. Even if you don't have a car, we will be able to coordinate better if we know you are willing to spare some time.
I am sure there are many members in NY. It is a big state with several businesses.

Is there anything to file for AC21 ? I somehow thought it's implicit and you just have to let USCIS know that you have changed your job. That's all. That too is not a mandatory task but most lawyers suggest it to play safe. I think it's matter of sending the letter with details to USCIS.
You just be prepared to explain at the 485 interview or reply to RFE's or NOID's if sent by USCIS, which wont happen till your 485 date is current or your sponsoring employer withdraws 140.

I believe you have to be in the US when your 140 is applied. Same goes for 485. Check with your lawyer. Once 140 or 485 is applied, you can travel outside.

Thanks for your suggestion. My lawyer says that it's fine to have Computer Information Systems as per Education Evaluation draft. Though my lawyers are well experienced, I'm felling little bit doubtful on this.

Although the job descriptions are pretty similar ( C coding, design, protocols etc.), my PERM was filed for Computer Software Engineer-Applications whereas the new one falls under Computer Software Engineer, Systems Software. Is this a risk during I-485 adjudication. Also my new salary is 50% higher than my original PERM salary (It has been almost 4 years since my original PERM).

I have applied my labor in EB3 category. As i am qualified for the senior position i have asked my management for the next level. so that i can apply in EB2 and get the priority data transferred from EB3 application.
with the July fiasco applied I485 with the EB3 application. Now my management is working to promote me from software dev to Sr software developer. Should i accept the promotion? my job responsibilites will be same with additional responsibilities. What will happen to my i-485 application if i take the promotion?

I think it means if you sent in your application then you can get a receipt by the date listed.
Atleast thats the interpretation I got from it.

There are LUD's twice on my wife's and my 485 in last 4 days first was on Friday 9/5 and the second was this morning 9/8.
RFE on my wife AP (131) was issued 2 weeks back, we haven�t received the RFE yet, Expecting it in a day or two, last week my wife called USCIS to find out what the RFE was, USICS customer rep opened a service request on her AP since it was more than 10 days RFE email and we haven�t got the RFE mail.
What could be the RFE for her AP, other than photo? Any clues?
Are the GC numbers available for EB-2 India for new approvals?
I am guessing the RFE is holding up our 485 approval, I know I being optimistic here, but who is not when it comes to GC. I will update my post after I see the RFE.
